My company filed my H1-B. The position they hired me had minimum requirement as BS no experience. (Though really what I do at my job, surely need an experienced professional and my company acknowledge that.)They filed my H1-B based on that position description. Now, I am filing my GC through the same company. They wanted to file my labour on RIR but the lawyer said that they can\'t do it as the minimum reqirement for job description was mention while they were filing H1-B doesn\'t suit that. My question is, is it possible to change the job description while they are filing for GC? Or, how that could be achieved?

Your post is a little unclear. I think you mean whether you can require additional years of experience with a Green Card case than you did with an H-1B. It requires a little creativity, but I do it all the time. You simply change the job title for the Green Card petition to a higher level position than the one you filed for the H-1B. The Green card petition is a future position that is available, which makes it work. e-mail me and I\'ll set you up with a phone consult.

Thanks.. that was my question.. my lawyer was saying that since my H1-B was submitted and approved for a position that requires no experience it is not possible to file my petition in RIR (based on economic slowdown and unemployment) but he could do that if the position required higher experience level.
