Is it possible 485 gets declined?

Hello, all

I saw this post from another immigration forum.

"I just got an I485 denial notice from the INS with no explanation. No appeal is allowed. My wife also has I485 pending, but she did not get any notice yet. I feel very sad. Thus means I am out of status now. where should I go? Is there any way to keep me staying here? My kid is still young. My family needs me to stay here to take care of. If I select to stay here, is there any effect on the immigration process of my wife and my kid? Their cases are still pending.

Ofcourse 485 application can be denied - there was no point in having the "application" if it was always approved. Can be denied due to criminal background, out of status, not meeting job requirements, etc.

However, ur quote seems strange.. no reasons cited and no appeal allowed.. never seen that before.. where did u get that from? Usually USCIS allows an appeal/Motion to reopen..

If this is true, then the reason must be "Security" issue. This person might have some criminal history and failed in Background Check clearance.

Just if somebody can answer this question.

One of my friend was given DUI ticket 2 years back.(He did 10Hrs classes & got 3 month suspension ). He was photographed and finger printed at Police station.

He has got his approved his I-140 recently. He confirmed with lawyer regarding this. According to lawyer he can check the box for "Never convicted ".

However he was not sure for that fingerprints.

Does anybody have any idea about this?

This is an impossible case!! There should be a mis-cmmiunication somewhere.
1. Have you checked if you have received all their letters/communications, etc. May be you haven't received that and you assume you received. Check on those first.
2. Talk to your attorney before it is too late!! There seems to be a chance that you provide information that is not valid. Even in that case it cann't be denied without any explanation.
3. Talk to a couple of good attorneys who have some good amount of experience.
In any case, you will be back in track as there are cases worst than yours and are resolved.
