Hi

140 ND 11/03 AD 05/04 (using a sub LC )
485 ND 02/04, 12/04 FP over
on 2nd EAD AD 01/05

Name DOB check pending ..

Is it Ok to change employers now using AC21 ?
My Employer says Attonery advised to withdraw 140 , if at any time filed employee not with company.

also I see some people in this forums who have changed employers and have had their 140s application withrawed from their old employers and have got RFE's.

Please advise.

If you have completed 6 months after filing 485 and if your 140 is approved, then your employer cannot do anything. What you can do is to file AC21 and just join whomever you want. But until 485 gets approved, try to work in similar job classification. Your employer cannot with draw your 140 after 3 months of its approval. AC21 helps you not to cancel your 485 if you have an approved 140.

Your employer cannot do anything. Find a job first and file AC21. You are in good shape.
