Is it ok to apply for AP, even if you have valid H1.

Hi,

I'm preparing the forms to apply for GC through my wife who just became citizen. I'm on H1 and working, and my H1 is valid till jan 2007. I don't have a H1 stamp since I never went out of the country since 7 years, and my status is always maintained fine in U.S. F1 - OPT - H1. My concern is:

1. Is it OK to apply for Advance Parole and travel on it, come back and work on H1 (which will be good).
2. Or not apply for AP and go and get the stamp in consulate (what if they deny the stamp for no reason, just afraid of that fact).
3. Take the Adavance Parole and keep it as a backup if H1 is not stamped.

Which one do you think is good and most appropriate.

Yes. And if I were you, I would.

You don't have visa on your passport & planning to get stamped.
