Is it mandatory to be on a payroll on the date GC approved?

Urgent help needed.

Can somebody tell us yes/no? Have you seen any similar cases that have got approved?

Here is the case and employment history.

Feb 02 2000 - Jan 04 2002 - Lay Off ( completed 220 days with Sponsored employer)
Mar 01 2002 - Mar 15 2002 - Another company with similar job description
Mar 27 2002 - Green Card approved
Mar 29 2002 - Apr 14 2002 - Left to India on Advance Parole (for 15 days)
Oct 07 2003 - Oct 15 2003 - Worked for another with similar job description
Oct 05 2004 - Till Date - Employed since then with similar job description

Why did you use AP after your GC was approved?

Other than that, it looks ok under AC21 (as I suggested in my previous reply to your wife's situation). There is of course rather a long gap between layoff and finding new employer, but even this should be ok so long as you (she?) was actively looking for work in the same field.

I'm more concerned about my wife not on any payroll on the day on which she got her GC approval.

She had to use Adavance parol as she didn't get her GC card by the time she started going to India.

This lawyer we spoke to was insisting on the fact that she didn't work on the day her GC approved, and was suggesting us to withdraw based on that fact.

I am posting my questions again:

# Since she was not employed when her Green Card was approved, will that cause any problem at the interview?
# Is there a requirement that she should be employed when her Green card is approved to be eligible for Naturalization interview?
