Is it legal to maintain US GC and Canadian PR? If so, how?

Hi Folks,

Any timely suggestions would be highly appreciated.I am a US green card holder. I am expecting my canadian PR soon. I would like to maintain Canadian PR to sponsor my parents. At the same time, I would like to maintain my US GC for career prospects.

1. Being a US GC holder, can I land in canada as PR? Will it have any impact on my US GC?
2. How do I maintain dual residency (US and Canada) ?
3. While returning from Canada, do I have to show my US GC to enter US or Canadian PR?

Thanks

tough to maintain both for more than 6 months.

ideally the moment you get another PR your prev PR can be deemed to be voided. so dont travel too much between the countries.

as a canadian citizen supposedly .....

as a canadian living in canada (mexican in mexico) there is supposedly an exception to the green card requirement to live in the US and only commute to the US for work - the commuter green card.

You obviously do not fall in that category. If you apply/accept Canadian PR you will have a very hard time pursuading the INS that you do not intend to abandon the US resident alien status. It is not axiomatic but I believe that the burden of proof is on you to prove that you did not intend to abandon the US.

It would also be difficult (impossible?) to sponsor your parents as a PR without paying tax in canada. How wd you demonstrate financial adequacy?
Consult a lawyer.

Similar question

I was reading some of the answers to similar issues and I am concerned as to what happens to the assets, in US, of people who go to canada for the canadian visa stamp and the immigration official tears your US GC? Can you return to US using Canadian GC and clear your assets? will the US govt appropriate them if the US GC is torn or invalidated on the border?

That is one for the lawyers. I personally dont think they can do anything to your property.
