Is it just a rumor that you can't apply for a US visa within 6 months of landing?

hi guys,
please help me with this one. Someone told me that you can not apply for the US visa within first 6 months of landing in canada. Seems weird. Is it true or just a rumor. My mom would be landing soon and then she plans to go to US to see my brother.
Is this really an issue? Thanks for help

As far as I know, it is not true. I heard from a guy that he obtained US H1-B visa the next day he landed as immigrant few weeks ago. Then gain, if it is a new law then it could be unknown to me. For accurate info, please call up the US consulate in Canada.

but why does US consulate care about your closeness to canada? sounds really weird to me. it's like having a landed immigrant status is some kind of disadvantage.
what about F1 visas?

also i was looking at US embassy in canada's web site. i couldnt find any such information there. bhand11683 could you please tell me the source of your information. some link to such info?

bringing on top.
please see if anyone can help. this is a really important issue for me at this time.
thanks all!

See on the Interview letter when you get from the embassy . If you are looking for visitor visa for USA from canada then you need to prove your "ties to canada" like job, salary ,mortgage etc .

This is normal for all visitor visas everywhere .

H1B is a dual intent visa so nobody cares about closeness to the home country in that case .

canada & us are different countries. They don't have time to discuss about your case.Your rumour is wrong. Some stupid people always create rumours & send it to public. You are all set. Don't worry.

Before a visitor visa is issued, you have to convince the consular officer....

1. You are not going to stayback in the US. f\For this you will have to prove sufficient ties to your country of residence. Sufficient ties in this case would be having a fulltime job, It dosen't matter if you are in Canada/India/Pakistan or elsewhere.

2. That you are not going to become a public charge in the US.

It dosen't matter how long you have been a landed immigrant, if you are able to convince the Consular officer, then you might be granted your visit visa to the US.

Certainly Canada and the US are two different contries, but if I masy ask as to where you got the information as to the Consular officers don't have time to discuss about your case? This is what their job is all about. Have you been to US Consulate in Canada to get a visa stamp in your passport? If not, you should try and obtain one so that you have the experience as to what the facts are...

perplexed,

is your mother coming as a PR or visitor?
i know of a PR who got a one yr US visa after 4 months of landing, with no job in canada either, thus that 6 month rumour for PRs isn't true.
in case she's a visitor, US consulate does infact mention on the site and within the interview/application kit that they urge people to apply for visas from home country thus visitors to canada might have trouble getting a first time US visa. if your mother is staying with you, she can take her documents indication sheis planning to make canada her home (in case she's a PR), like health card etc and if your mother has another relative in the US, shecan take a invitation letter from that relative sayign she's just visiting that person.
also, lately US has eased a lot in granting visitor visas to can PRs. most people i know of in the past 2 months, none got less than 2 yr visa and i got it for 5. this was less than 2 weeks back. hopefully your mother shouldnt have any trouble.

hope that helps.

thank you all for your replies. my mom is coming as a PR. let's see what happens.
also does anyone know how long it usually takes to get interview/visa after applying at the US consulate?

You will have to make an appointment first. If you call now, you should be able to get one for next month. The US Consulate in Toronto, asks to pick up passports the next day. I am not sure about other consulates.

Hi! perplexed-

You are all OK to get visitor visa. Just apply from Ottawa. Take an appointment on web & you are all set.

thanks ali.
why in ottawa?
because i live in toronto area and thats where my mom and sister would stay i think it'll be more appropriate for them to apply in toronto. do you think there is something wrong with consulate in toronto?

thanks
