Is it illegal for H-1 Holder?

Hi,
My friend is on H-1 and he has given some technical assistance to
some company on friendly relation. That company wants to pay him some amount for that with check against a simple In-voice stating my friend given technical assistance for so and so many hours.
For business reason that company wants to pay in Check and not in cash. The company also says that they don't even need to have my friend's social security number etc and no information is provided to IRS. The invoice is for office and accounts records only.

1) Will it be illegal for h1 visa holder to accept such check for some temporary assistance he has provided.
2) Is there anyway to pay tax on that amount. ( Very frankly the check he will be receving is less than $300)

Please advise!
 
Don't worry

Don't deposit check in his account. juts find that bank and encash it in person.

Frankly, it won't be big thing for less than 300 $. but for the safer side they can make invoice on name of some friend/ relative who has green card and can accept check.

JB's advice is related to the probability of being detected. Just because your friend can probably get away with it doesn't make it legal.

You knew it wasn't legal when you asked the question.

Pretty stupid to take a risk of incarceration (technically, the failure to report income is also tax fraud) and removal (violation of H-1B status through illegal employment) to gain less than $300.

I'll grant you that the probablity of any of the above happening is virtually nil, but why take the risk.
