Is it by law that we have to file Labor Certificate 365 days before theexpiration date on our H-1B?

I would really really appreciate if someone would be able to answer the question..!

Sept 30th 2011 is the last day on my 6-year H-1B. I learnt from my HR that if we are going to start the green card process, we have to have the Labor Certificate filed by Sept30th 2010. Is that correct?
