Is Indians will have only 9800 Green Cards per Year?

My friend telling as follows:

As per the new memo, INS going to grant only 140,000 green cards (world wide) for Employment based category. Out this 140,000, any country can have max of 7% = 9800 green cards per year for all EB1/EB2/EB3.

If it is true,

For EB3 priority date is 01/01/2002. Suppose total GC applicants in the month of Jan’2002 from all processing centers are 20,000 EB3 priority date will stay back at 01/01/2002 for 2 years, since per year Green cards quota is 9800.

How far it is true? Please give your views on this…….

India can grab unused green cards from other countries. So, it can exceed the 7% mark if other countries couldn't fulfill their quota of 7%.
 
Moreover who cares about those figures ? Green card eventually gets approved only timing varies. If you are doing better things then don't worry.
 
9 million? far from it, the total Indian born population in US is ~ 1.68%. Total pop ~ 290 million.

That's correct . Those who are going to be afffected by PD should concentrate on what they can do best under the circumstances. If their I140 is approved and they passed 6 months in I485 stage, they should use AC21 and choose good jobs. At this time it is difficult to get into the numbers, but the coming year might be very tough for indians who have filed in Eb3 and having PD > 1/1/2002. I guess that indians account for more than 25% of EB category GC.

Agree. I am EB3 and with PD in DEC 2002, I don't see things turning green for me in near future. As suggested I am looking for AC21 options w/o getting depressed :)

I posted this message before in a different thread.

I have found that last year there was 82,137 EB-sponsored GCs.
Out of all cases filed 67% were I485 AOS, the rest were CPs.
The EB3 cases were 46% out of all I485 EB AOS or 26,303 cases.
If the proportions are kept the same then the total number of the EB3 GCs issued in 2004 or 2005 will be 44,832 (46% of 67% of 140,000 - visa limit).
Out of them only 7% can go to India so the annual limit would be around 3,138 a year.
The primary/dependent ratio is usually 1/3 so only 1000 EB3 Indian families would be able to get their GCs a year.

In 2003 due to the temporary removal of the per-country limit India got 25% of the EB visas instead of 7%. That is three and a half times more it should've. As a result the PR date was moved three years back.

Your assumption is right. USA gives equal quota to every country. Later I think in 1998 or 1999 they have changed the rule. The unused quote of GC from one country to be transferred to another country. So do not worry you will get it sooner than you can think about.
