Is I 131 needed?

Hey guys,

I am on H1 filing for GC thru USC.
I am all set to appy first thing on Monday morning.
I am not sending the I 131 application since I dont intend on travelling abroad.
Still..Is it necessary to send this application?

Can some1 please inform me?
I am filing with following documents :

EAD: I-765
Form
+2 pics
+copy of I-94
+check 180 $

I-485

+ 1 G325 only me.
+ 2 pictures
+Birth certificate (notorised copy)
+copy of visa issued
+i-94 copy
+ marriage certificate copy
+medical examination (original )
+ check (395$ payable to ?)
+I-864
+I 864A

I-864 - Notorised
Tax returns - my wife
Earning Statement -my wife

I 864 A - notorised
Tax returns -myself

Employment letter

I-131 is optional. You don’t have to file it if you don’t want to. If you change you mind later – you can always file it later with NOA of I-485.

P.S. make you check payable to U.S. Citizenship and Immigration Services.
 
The only thing is if you change your mind later or an emergency comes up then you should wait up to 4 months to get one.
 
If you plan to remain on your H1B till you get your GC, I-131 is not needed as you can use your H1B for travel. When you use your EAD for work, you lose your H1B and this is when you need your I-131 in order to travel.

If you have plans to use EAD for work, i would suggest you spend some extra money and have the AP in hand because emergencies dont give advance notice before they come. You dont want to get stuck in a situation where you have to leave NOW but have to wait 90 days to get your AP approved. Walkin at the DO for an AP wont help much as you have a real lot of convincing to do to prove that your situation is really an emergency and that you need to travel. Your request would be denied if you cannot prove that your travel is an emergency.

My 2 cents... your call though...

P.S: As per the instructions on the forms, you need to make the checks payable to Department Of Homeland Security. Look here for sample cover letters.
