This is about my brother in law.
His labor certification and immigrant visa petition (I-140) were approved last year. Since he was not married, he preferred to wait for filing Adjustment of Status (I-485). The six years term of his H1B Visa is expiring on December 8, 2002.
Now he wants to marry a girl in India in first week of November. He is going to file I-485 application next week . I have following questions.
1)Is it possible to get H4 Visa for wife when H1B Visa of husband is about to expire in a month (or less than that). If yes then is it treated as a special case or it is something quite normal?
2)In case H4 visa is denied, what other alternatives are possible to bring his wife to USA. And how much time will those alternatives take ?
