I had sent my Indian passport to the DOS for stamping of my new H1b stamp. Apparently, the immigration department in my office forgot to put a UPS envelope in the application packet and now my passport is lost in the mail. I am planning to apply for a duplicate Indian passport at the Indian Consulate in Houston. My question is, can I file the I130/I485 without my H1b stamp and only my I797 approval notice, or will I need to wait for my duplicate passport, get the H1b stamp and then file the I130/I485?
