The information I've received so far on such cases have been very few. With a 92 day stay stamped on the 7th visit to the US the CBP officer wrote No AOS, EOS, COS on my father's I-94. He also mentioned to him you must stay in your home country for 6 months before you enter next time or you will be denied entry.
Reasons mentioned were too many visits and long stays. Only recently after mother's passing, it has been long. In 2004 (with approved extn stayed for 9.5 months) and 2005 (with approved extn stayed for 10.5 months). At no time he has been out of status.
One Lawyer in CA says that such cases are fine and should not be a problem and wants to file quickly. Should I insist for concurrent I-130, I-485 and I-131 filing after 60 days. Another laywer says it has a 70% chance but CP has 95% chance.
My dilemma:
Do not want my father to go back as he will be alone for a long time during CP and also do not want any AOS rejections that will have any bans.
My fear:
Repurcussions if AOS is filed after this note on I-94. If AOS is filed 1 month before date of I-94 departure is there a possibility of OUT-of-Status while waiting for receipts??
My hope:
Anyone with similar experience for their parent please post with dates etc.
