Is ETA-750 form needed for I-140 NIW?

Hi all,

I am preparing an appeal for a recent I-140 NIW
denial. In the denial letter, it says:

It is noted that the record did not include a copy of an
uncertified labor certification as required by the Form I-140
instructions. If an appeal is considered, please submit an
uncertified labor certification.

From the I-140 instruction, I think the above refers
to the ETA-750 form. But it seems to be irrelevant to
NIW petition since the labor certification process is
circumvented.

Does anyone know if I should submit the ETA form?

yes it is required

Yes!! i beleive ETA 750 B form is required with I-140 NIW.

It is partial form not complete labor process which i beleive you can do it all by yourself

Yes! ETA 750 B form is required with I-140 NIW, but not with EB1 EA.

The service center simply implies that your petition file was not complete and can be adjudicated. You should fill part B of ETA 750, if you want to submit a new file.
