Is DNA performed At Medicals.

I am dv2016A.F 13xxx and am the principle applicant. I have two kids and one is my step-son. When I married my wife she already had a son from her previous relationship. On my initial application I indicated am married and have two kids. We would not allow the father of my stepson to know about our dvprocess because he won't allow our son to relocate with us. So I will not indicate anywhere he is my stepson. I highly suspect I will get away with it cause he very much resembles me. Yes I know it's termed as fraud but it's for a good reason. And note that his father is a deadbeat dad.
Now my worry is when I attended medicals do they conduct DNA. That's the part that is worrying me.
If they do then I might be permanently barred. If they don't then that means we will get away with it.
Also note that we consulted a lawyer about getting permanent custody, but this process takes years and time is not on our side.
His dad hardly ever comes to see his son. The last time he saw him was almost 9 months back, and he also has remarried and moved on.

I don't think you are thinking this through well.

First. They can order DNA tests, but that is not part of a normal routine.

Now about your stepson. He is your son as far as US immigration law us concerned. It is assumed that you and the mother have parental rights, but you may be asked about custody (although that is not certain). The biological father may have some legal custody, and if asked about that you should not lie. You will of course have to show birth cert for the children, and the cert for your stepson will show both the parents names.

Don't try to "get away with" anything. That is not how you want to start your relationship with the US government, nor should it be how you conduct your family affairs.

They can do a DNA request if they are suspicious, which they might well be for example given the discrepancy in his birth date and your marriage date. It's more rare for DV than other immigrant cases but I do recall at least one case on this forum where it happened.

Now to be practical...

How do you plan to find a birth certificate listing you as the father?

You know what you plan to do contravenes US law and even if you manage to get away with it at first (which I highly doubt you can, see above), you will get you deported if found out, for example at your citizenship interview?
While you may think it's "fraud for a good reason" the law will not be on your side.

If you are so sure that the dad doesn't care for his son, ask him for a letter giving permission to take him with to the U.S.

Finally, no one on this forum is going to assist you to commit fraud and break laws, no matter how justified you might think you are in doing so.
 
Oh and, what you plan to do is termed international parental child abduction. In the unlikely event you succeed in passing the child off as your own, all the upset biological father has to do is go to the U.S. embassy and tell them what happened....then at best you will all be deported and you and your wife probably banned for life from entering the U.S. ; at worse you face jail. Really worth it?
 
Thanks Britsimon and SusieQQQ, Will call the embassy later and ask about which documents I need to provide regarding my step-son. I just talked to my lawyer and we have decided to file for full custody, and also he stated he will also ask the court to provide written documentation pending hearing of the matter allowing us to travel with my son.
I will pray all goes well during our interview.
