I have a case where I am with company XYZ and AEC under RIR is already filed since Sep 2002 in EB3(I had only BS then). My application is currently in BEC Philladelphia, and my lawyer has responded to 45 day letter from BEC.
Since I joined my current company I have gained 4 years experience and earned MS degree as well. Since I don't know when my labor will come, and EB3 is unavailable anyway, I was thinking of changing my category to EB2 and refile through PERM. My lawyer said degrees and experience earned with current employer cannot be used for my application to file as EB2 in PERM.I am willing to change employer but have following doubts:
1) Is changing employer and filing thru EB2 a good decision for my GC, since in EB3 at current employer my PD is Sep 2002? Will EB2 in PERM thru new employer get me GC faster than EB3 (PD: Sep 2002) thru current employer?
2) If I change employer, is it necessary to cancel my AEC application with current employer before moving to new employer, or can I just move to new employer and file a new case without worrying about the pending AEC on my name through previous employer?
