I contacted TSC using POJ trick to find out the status of my 485 application. The lady told me that my application is "waiting background check". I asked her if that is same as name check, and she said no.

Is this correct?? Does anyone know what is difference between background check and name check??

I believe it is different ...

TSC05,

From all I have read I think a background check is different from a FBI namecheck. A background check is carried out by the CIA and apparently they check with agencies in the country you lived in prior to coming to the US. The FBI namecheck is another beast in itself.

Thanks ...

Thanks saras76. You seem to know a lot in these matters.

Do you know if these checks are done in any specific order? (The TSC lady was not willing to disclose the status of the name check process)

TSC05,

I have heard that these checks are initiated as soon as the 485 is filed. As far as I know, there is no particular order. There really is no transparency in this process so its hard to tell exactly how things work. The best we can do is guess.

Please do note that even at the moment of adjudication, the inspector is supposed to perform final background-checks. Only at that point, they formally approve your petition.

Yes, background check is different from FBI name-check. While it gets started at some time during the process of I-485, there are many background-checks all through the various stages. One final time they do is just at the point of adjudication.

I was a first-hand witness to this fact, when I got mine approved at Atlanta District Office.

Background check

I got the same message from USCIS, and after reading messages on this forum and talking to my lawyer, this is what I think:

Background check is a generic word for the the 3 checks that USCIS does:
Fingerprint check
IBIS check
Name check

Since you need to go through the IBIS check even for EAD or AP, and fingerprint checks are usually completed in 48 hours, when USCIS is talking about background check pending its usually the name check. So if your EAD/AP is approved at least once, you generally do not have any problem with IBIS check.

Hopefully I am wrong, because I am also stuck.

I think "background checks pending " can be trasnlated to "name checck pending". I find this is the only bottelneck.

Thanks poong ..
