Hello,
   Is anyone who has applied for I-485 and travelled without I-485 receipt and returned on H1 status. Also, how long does it take to receive the 485 receipt ?.

thanks a lot

A friend of mine

went back to India last week (Nov 20). He submitted his I485 on Sept 10 (I think) and he hasn\'t received the receipt yet. He will be coming back next month using his H1 visa.

Yes.

I did travel without a receipt. I also know a friend of mine who traveled without a receipt. In both the cases the service center is VSC. I do not see any problem with traveling with out receipt. There is plenty of information on the web(Including INS website). Travel AOS, AP and dual status intent e.t.c. would clarify why it is legal to do so.

Just my two cents, please check with your attorney.

No Problem

Applied for I-485 at VSC in April 12. Gone to India in May 29. Got 485 Notice on June 23rd. I reached US on June 30th.. No problem ..

Did the same for CSC

Mail date 04/30
Left U.S. 05/24

Got back 06/17
Got receipt 07/11

travel while 1495 pending waiting for receipt?

Was advised by my attorney not to travel while waiting for i1-485 receipt notice. otherwise 1-485 will be regarded as void..appreciate any advise on this?

My lawyer recommended that we did NOT show our receipts unless specifically asked for..

Infact, they said that it didn\'t matter if one had a receipt or not as long as you either had a valid visa or AP to use while entering the country

i-485 travel without receipt notice??

http://www.ins.usdoj.gov/graphics/lawsregs/handbook/travpub.pdf

The above document mentioned that if we travel before receipt of notice of filing for I-485, the I-485 will be considered as abandoned.

Am concerned as my attorney will be filing for my 1-485 this week /next week and I will be travelling out of the country before receiving receipt notice. Does this mean that my I-485 will be considered abandon???

Ref: i-485 travel without receipt notice??

To the last posting giving the pointer to INS web site for clarification - that memo applies only for change of non-immigrant status ,i.e.,
H4 -> H1
F1 -> H1
H1 -> H1 (new employer)
H1 -> H4

It does not apply to adjustment of status because as the name suggests that process is unique and totally different from change of status which applies between non-immigrant classifications only.

Please consult with a lawyer, however I must state that I did travel after applying for I485 and used only my visa to enter the country without any mention of pending AOS application with the Service.
My case was approved without any issues or RFE (NSC).

Best of luck!

Yup..Travelled just this month

hi
My I-485 was applied for ,and I had carried my receipts.My H1-B is valid,and so I travelled on the H1-B,and returned,with no problem..Do not mention the I-485,IF U have a VALID Visa on which u r travelling - if u have the EAd,and AP,it\'s a diff case..I just arrived last week,and had no problem at all..
