Is an Interview for I-485 always required?

My online case status changed to Interview descheduled, though I never received an interview notice. Our lawyer indicates that he will inquire as to why our case says that status when we never had an interview scheduled (the previous status said "RFE received and the case has resumed processing").

He indicates, though, that he has had cases where the people applying had their GC approved without an interview. Is that possible? Could that be my case? Our situation is the following:

The I485, I130 and I765 are for my wife. I am a US citizen, as well as both our kids. When we sent the evidence, I sent proof that we've been married 8 years, as well as the birth certificates of our 2 kids. She is here legally(her visitor visa expired on the 31st of Jan, but we submitted papers before that). Will the fact that we've been married so long and have children suffice the USCIS need to verify if our marriage is legit?

If this help, we attended interview last week and waiting for the namecheck clearance ( God knows when that will be ). We have been married for 5 years and had kid too. There are lot of others in the similar situation attended the interview from this group. Double check with your attorney.
 
I would say each case is different. Depends what you status was when you entered the country for the first time, what status were you on when you filed for the adjustment, medicals, evidence, background check... etc.. so you never know what may happen. It is possible that they are convinced and will send an approval, but you never know until you hear from them.

The only time I've seen someone get a green card through marriage without an interview, is when they have been married for less than 2 years and the green card is conditional. As you have been married for 8 years you will have an interview (as you will be getting a 10 year green card). Don't sweat the interview though, if you've been married for 8 years it will be a formality.

Did you try to call them and ask why your interview has been descheduled? Sometimes, online status is not accurate. It won't hurt to call them or schedule infopass appointment (if you live close to USCIS service center) and reconfirm the status.
 
At the time my husband (USC) and I (cdn citizen) when we had our interview the following week was our 20th anniversary and we have a 12 yr old USC child...We had a interview and I was stuck in name check and finally just got my approval notice ...Good Luck and you should have n/p getting your wifes GC

Hello, I did call, but they said they had no information about Appointments. All they did was confirm my Mailing address, which was correct. They couldn't explain why I got a Descheduled noticed without first even receiving an Appointment.
 
There seem to be a lot of people that have gotten an email regarding de-scheduled interviews who never received an interview appointment in the mail. Apparently it is a bug and conventional wisdom is: if you never received an interview notice, ignore the email; if you did receive an interview notice and get the email, ignore the email and go, unless you get a physical notice in the mail that your interview has been re-scheduled. So in your case it's most likely a bug.
 
help with DORA pilot program

Hi y`all,

I am a new member on an F1 visa and just got married to my sweetheart who is a US citizen.

I would like to get a clarification on the process involved in the DORA program. Do you have to get an appt through Infopass first, and then take all your docs(I-130, I-485, medical exam, affidavit of support) to the Dallas office for an interview OR first file the I-130 petition, get an approval notice and then book an appt for an interview where u submit the docs.

Any help from this great forum will be appreciated as i am a little confused about which one comes first.

Hi:

For DORA, you get all the documents ready first, including the medical packet etc. Then go to an interview scheduled through Infopass (check the option for the DORA pilot program). You do NOT submit I130 first.

It seems that this may be what happened. My lawyer and I went to the Atlanta Office with an INFOPass appointment and it seems our Interview was scheduled and then canceled 5 minutes later.

It is a relief because he was worried we nor he got a notification. They could not explain why it was created and canceled immediately but told us to just wait for the reschedule. But it does explain why we didn't get a notification through the mail when the interview was scheduled.
 
Got The Interview Notice!!! Yes!!!

Got my interview notice, yahoo!!!! It's for the 17th of April, 2007 and will be held in Atlanta!!!
