hello everyone
i got a question about AC 21.
i applied for my I 485 in August 2007. i applied for 485, EAD and advance parole for my wife also.
but my wife still has 5 years left on her H1B.
my question is does the AC 21 rule apply only to the principal applicant(Me) or for the dependant(my wife) also.
i mean does my wife also have to wait 180 days before she can transfer her H1 or there is no such restriction for her?
and she never applied for Labor or 140. so if she transfers her H1B, what kind of job description should she have? should it be the same as her previous I 129 or can it be anything?
and is there any restriction about the geographical location or any other factors that we should keep in mind while transfering her and my H1visas.
