Is a H4 visa holder eligible to apply for EAD

Hi I have come to USA on H1B and my wife and kids join me on Feb 2008 with H4 visa. My question is about H1B dependent working. Is a H4 visa holder eligible to apply for EAD? Or is there a way for an H4 visa holder to work in USA?

If an H1 holder applies for AOS(I485-Adjustment of status), he can receive EAD if he applies for one. His spouse can apply for AOS with her husband or separately based on her husband's pending I485 if she is in US(which she is in this case). Law allows to apply for EAD at the time of I485 application as well as later based on a pending I485.

EAD is for adjustment of status (AOS) applicants until they receive their GC. Unfortunately as long as she is on H4, she can't work. But she is eligible to apply for H1 which will enable her to work.

Hi Jefkorn,

Thanks for a quick response. Dose she has to go throu the normal process for H1? Me being just 6 months in USA I am I eligible to apply I485
