I had a I-485 AOS application (employment) pending when I filed my marriage based green card (my spouse being USC) as the existing application was not moving at all for whatever reason. Had 2 interviews after that.
During the frist (marriage based ) interview in MArch 2008 IO said:
1. my case is under background check.
2. she was approving my I-130,
3 wait for 90 days and my application should be approved.
4. the I-94 was taken out and the IO had written IR6 with 485 pending in the passport page that had the I-94 atached.
During the second interview regading employment based 485 in May end 2008 :
0. My cases will be put together as they were in different offices at the time of second interview and were not available for IO to see them
1. IO had again written IR6 with 485 pending in the passport page that had the I-94 atached with a new date and name.
2. On asking about my EAD due to expire in 3 months, IO suggested that she wouldn't apply for EAD now if she were me and asked me to wait for 60 days for decision
3. I was advised not to travel until a decision is made
Curent status is:
1. I haven't received I-130 approval yet.
2. Haven;t heard on either of my 485 yet.
3. 55 days are over and my current EAD will expire in another 30 days and I recieved a letter saying that my employment based application is under further review and may take anotehr 6 months.
Questions I have are :
What does IR6 with pending 485 means ?
Is it ok to apply for an EAD or should I expect a decision to happen in next few days?
What happens after my EAD expires? Do I have to resign from my current job or is it ok to continue working?
What is background check and what is name check? Are they the same thing or there is any difference?
How long this process takes ?
