V visa and greencard

My wife was issued V-visa and she came to the US from Madras and is now back again.Her V visa is valid for 10 years.Her priority date for greencard comes up soon.What if she delays this interview?Should she absolutely get the greencard or can she be visiting the US using her V visa?Thanks.

Richa - Info and Help Needed

I am in a peculiar kind of situation. The Client for which I have been working for the past 3+ years wants to hire me after my GC. I have my Figerprinting scheduled for sometime next month.

If I am not mistaken the law says that after GC there should be an intent to permanently work for the sponsoring employer. If the sponsoring employer gives me a letter saying that I have to join my Client and the Client also says that he wants to employ me. In this scenario do I have a valid and bonafide case of switchover of employers at an early date after my GC gets approved.

How does INS track change of employment and do you think I should consider this option because I have been working for my sponsoring employer also for more than 3+ years? In this scenario at what stage/timeframe should I make a switchover.

I will really appreciate a reply to my this querry.

Labor status in Kansas

I have applied for GC 6 months ago in Kansas City. I have been tracking the RIR processing time for State Labor in Kansas City and it has not moved beyond 03/23/2001 where as the other states have been moving. Is there any specific reason behind this. Any information is appreciated.
 
Moving Jobs after Labor certification

Hello Richa
If I move jobs after labor certification, can the new company continue from there and file I 140 or do i have to go through fresh process. Are there any exceptions for the rule to see if i qualify?

Rajiv says if your l cert is approved and you change employer, you cannot use the approved l cert with the new company. You will have to file a fresh l cert with the new company. There are no exceptions to this but if your new employer has an approved l cet which they have not used so far, in that case if you meet the requirements of that lcert at the time the l cert was filed you can straight away file I 140.

Sub: Relocating to a differnt place from the same company during GC processing.

I am currently in CA and applied for my Labour in Jan 2002.
Now my company wants me to move to East coast for the same position.

(I do not want to reapply for my labour since I am fast approaching the 6 year limit)

Since Green Card is for a job in the future, I guess you do not have to be physically be present in the state for the GC process, in this
context,
1. Can I move to East coast without affecting the labour certification
process here in CA and when the I485 is applied in CA and after 180 days can my company request INS for change of location??
2. Is it true that you can process your GC in CA when I live in another
state in East Coast?
3. Does at any stage of your GC do you need to have an apartment in CA as a prerequiste for getting your GC??

Is this feasible? Are there any risks?
