Intreim EAD - 90 day Rule Clarification

Hoping that folks here can help with my below question regarding EAD RENEWAL:

My wife's I-485 is pending since June 2003 and EAD/AP (that were issued last year) are expiring on October 1, 2004. Our lawyer did not inform us in-time to get the renewal started soon enough. Now, the application for EAD renewal will be filed by August 10 (hopefully !) which means more than likely will not receive the renewal before October 1, 2004.

Can we go for Interim EAD (in San Francisco office) in case our renewed EAD does not come through even though it will not be 90 days since the new I-765 will be filed ?

Does 90 days apply to interim EAD renewal as well (when 1-485 has been pending for more than a year)? I-140 has been approved since November of 2003.

IS E-FILING of I-765 A BETTER OPTION IN OUR CASE ??
 
The 90 day rule applies to the interim EAD but there's no harm in going before 90 days and trying your luck and keeping your fingers crossed. All they can do is refuse to give it to you.

I renewed my EAD by applying online. I got approved a little over 2 months. MY service station was NSC. I am not sure how what the timeline for CA is.

The only positive side of E-Filing is your application date is a couple of days earlier than sending it through regular mail. And another plus side is you get your photo/fingerprint taken by immigration support centers, therefore it is very likely that you cannot get an RFE for them, whereas alot of people are getting their RFEs b/c of photos.

Another suggestion is to get everything color copied, and make sure they are clear and readable.

If you get an RFE, it can delay your application as much as 2-3 months. I was going to get mine approved on the 51st day, instead I got an RFE, and I got approved a little over a month after submitting the response.
