Interview was in 3/2005...Now What???

Hi everybody,

This is my first day/post on this forum and I was wondering if someone could give me a few pointers on my situation. I'm sorry if I'm in the wrong area. Here's my story:

I had my interview in 2005 which I passed. I was told that they just introduced a system that you could get sworn in the same day but they told me my background check was still pending and I should hear from them within 90 days. I figured since my name was very common that it was not a problem.

After waiting and waiting, a friend of mine a few months back told me that unless I take proactive action, they will hold my citizenship indefinitely. I have not committed any crimes and I am a taxpaying working professional. I have had my Green Card since around 1993.

My friend told me that I had to sue INS (or whatever it is called nowadays). Is this true?

How do I go about this process?

Any help would be greatly appreciated.

Your application is probably stuck because of the requirement of a FBI namecheck. The process checks any occurance of your name (or similar sounding names) that appear anywhere in a criminal investigaion. Here's a description of the process:

According to 8 USC 1447, USCIS is required to make a decision about your application within 120 days of your interview. Since they have not made a decision, you can sue in Federal court to force them to make a decision. Read this thread for more info:
