Wonder, will there be questions on current employment. I never worked for the sponsored company during, before or after my GC as the company couldn't generate the job. Will this create a problem?? Can some one please, help..

So your saying you have not filed taxes in last 5 yrs ?If it is employment based,They have to prove they paid you and all taxes .They paid you to sit home all this time.? :rolleyes: You will definelty have lot of explanation to do.

I think it would be good to consult a lawyer about your situation. On face value your situation could be misconstrued as having obtained your Green Card fraudulently. I have no personal experience in this area, but I think there are companies that somewhat create fictitious jobs for people to obtain Green Cards and they could look at your case and consider that this is what happened with you. I know that a lot of honest applicants got caught in a situation where their employers put them on the bench during the downturn that started in 2000. However, your situation seems to look worse because you never worked for your sponsoring company. Anyway, my best advice is to consult a lawyer. I don't mean to scare you, but in your situation I think it is best to pay for professional advice than just hope for soothing words from this forum.

My 2 cents.

If I were a USCIS adjudications officer, I'd be asking some tough questions relating to how you obtained your GC without ever working for the sponsoring company - after all, employment sponsorship is not normally an inexpensive process, so the company didn't exactly get a good return on their investment.

Two ways forward;
- get a good lawyer with prior experience in this area.
- wait long enough before applying, so you don't need to list your actual employer at the time you obtained your GC. (5yr employment history reqd on N-40)

Good luck.

Please provide more details

How can anyone help you with such a vague question.

When was the I140 filed, I485, when did you start
working for the companies listed on your N400.
Provide dates. Perhaps you could make use of AC21.
