Hopefully someone may have come across a situation like this. I am getting my status changed through marriage of US citizen. Yesterday during my interview the officer saw that I lost my I-94 and passport (I was 2 years old). However, my father back in 2006 had applied for a labor certification and therefore made me eligible for the 245i waiver. The labor certification process was never approved.
My attorney said that the LC did not need to be approved and therefore still make me eligible - which the officer seemed to understand. However, he said that he would need to verify this with the Dept. of Labor. He said that we should hear something in a week or two. The interview lasted a total of 5 minutes.
We had the paperwork to show that my father did submit for a labor certification, but he said that he would need to check.
Does anyone know what may happen or have a similar situation. The official gave my lawyer a continued for service action letter in which he check marked a statement saying that may case is pending further review.
