Interview Notice after RFE

Gurus,

I got an RFE for my 485 (EVL, W-2 and paystubs). I responded to the RFE on 11/22 and then there were couple of status updates. Today, i.e. Dec 6th I got an email from INS saying that my case has been transfered to Cleveland office for further processing.

I am worried and confused what is going on. I have few questions and will appreciate if you can answer all or few of them.

1. Is it normal to get an Interview after your respond to RFE?

2. What can be the reason or trigger that resulted in this interview.

3. How long does it takes for one to get an interview letter.

4. Another thing, my paystubs are upto date, with nothing missing but the salary that is been shown on my paystubs is more then what is declared to INS in the EVL letter. There are couple of reasons for it - the way payroll was run and i am working on profit sharing basis. So is that be a reason and if yes then what I need to do - any counter measures.

Any advise/suggestion/insight will be really apprecaited.

Not all the dictrict office transfers result in interviews, sometimes they do it to reduce on on service centers. However, in your case as RFE part is done, probably, I guess, it is transfered for conducting interview. I personally know a person who got approved after 2 RFEs and then interview. His employment history and current (In I-485 stage) job profile was not straight enough.

If salary reported in EVL is significantly lower than the same mentioned in labor..one may see transfer. if in your case if your salary is more then the same mentioned in labor, you will get approval w/o any problem

thanks for your prompt replies. As far as my salary is concerned, it will be approx 10 K more than my base salary shown on my EVL. Additionally, I am also making overtime equivalent to 30% of my base salary.

Also, is it wise to go ahead and contact our area senator or wait couple of weeks to hear back from the local office- things such as waiting a yr to get an interview scares me.

After having gone through an RFI and now an interview - things were going smoothly until this stage and that is why I am a bit apprehensive.

Let me know your thoughts.

Is your EVL salary same/close to your LC salary (assuming your LC is for fulltime 40 week/hour)? I don't think 10K extra will be an issue. But I don't have any idea about other 30% overtime. But in this forum I have not seen any troubled case when income is higher than LC. Most of the times trouble starts when current income is significantly lower than LC salary (40 or 50% less) and current employer is the GC sponsorer.

It seems your file is "active" in this moment - it just got transferred to local district office. Wait for a while and also checkout the current processing timeframe in Cleveland office.

I just checked the current processing time, it is showing Aug 2003. My 485 RD is Apr 03. I also went thru some emails where they were talking about taking appointment thru infopass. Couldn't get a whole lot of information when and how infopass is used. Any Inputs/Advise.

Hi RS,

Infopass i scheduler which helps u fix an appt with the immigration agents. It could be for stamping/enquiries etc. Some of the forum members have used it to enquire about their case status when they have no information on their cases .Mostly in transfer cases it takes a couple of weeks for the case to land in the local office. U can fix and appt with the office your case has been transferrred and go mee up with the immigarion agents. In most case this helps to know where exactly in this complicated workflow your case is stuck. So try your luck and keep us posted.

There are many reasons why cases are transferred:
1) criminal history (citiation or any violation)
2) salary/job issues (unpaid leave, too high salary, too low salary, job description, etc.)
3) changes of jobs many times (before 180 days or after 180 days - results on tax returns)
4) medical results are not clear
5) fingerprint results are not clear
6) background check (background history-- misplaced addresses or years, or some addresses don't exist per government system, etc.)
7) visa status history (missing I-20 form, missing I-94, out of status, etc.)
8) just random checking
etc.

Don't worry.. you will be fine. You said about paystubs. I don't think it is issue. I think it is just random checking. During the interview, I think it is just a formality.
 
Take Paystubs

Take the latest paystub to demonstrate that excess salary is from the overtime (if at all it is specified, my paystub does show the actual and overtime pays).

Also hours per week and salary is listed in your labor application, more money can be made from overtime. I think that if one makes more money by working more (not by choice but due to organizational needs) is perfectly legitimate and understandable.

Most of friends got RFE's for 485 for W2's and paystubs and they all work atleast 6-8 hrs more per week (Production Support), and all got their stuff done with no issues.

This is just my thoughts.
 
Thanks everyone for your valuable inputs. This definitely makes me feel more comfortable then I was at the time when I got emails from INS. Can anyone tell how much time it takes( I know its difficult even for God to depict how INS Works) to get an interview notice. Is it dependend to Regional Office or Service Center. My case in transfered to Cleveland, OH.

I checked the link and it is saying Aug 6,2003. So the Receipt date is my 485 Receipt date (Apr 03) or the receipt date when the local office has received the Transfer Application. If it is the later, then it means another 1 year of wait process. If it is 485 receipt (Apr 03) then I should expect an interview call anytime in next few weeks or so.

Any idea, what will be the Recepit date.

My case just got approved but my husband's was transferred to Chicago. At the stamping I asked the office this question and was told that it is the receipt date of the processing center, not the transfer date. In my case it is also way past my VSC date, so he said that I should get an interview within 3-5 months if the transfer reason wasn't a security check.
 
Based on my experience in this forum, here are my two notes:
1) Transfers have nothing to do with Salary (more salary or less salary)
2) 99% of these transfers are harmless. Time and again we have seen that the interviewer asks you a set of routine questions (have you ever been arrested, have you ever been out of status etc). So your approval is almost guaranteed, what ever the reasons for the transfer
3) There can be many reasons for transfer : Previous employment status, marriage issues(to verify that you and your spouse are really wife and husband), bad history on your employer, some of the security checks returned ambiguosly, insufficient documentation etc.

Your replies do help me in clarifying my doubts, but I believe that with new PD, even the local offices will not schedule for an interview till the date are current. Mine is Lab Sub (Apr 03) so I believe till PD date is not back to current or Apr 03, I have to wait and watch.
