INTERVIEW LETTER…this is big!

Two of the people I work with who have filed for their spouses who are of foreign origin never got their interview letters and their cases have been denied (two completely independent cases)

After talking to one of them, he said that he found that this is a common occurrence. Is there anyway we can do to ensure it doesn’t happen to us? Those who have received their interview letters, did you status change on CIS’s website?

Please share your thoughts, ideas and experiences. THANKS!

What was the reson for deniying?

Can you tell us what was the reason for the denial?I have never seen some one getting their application denied for Family based.
 
Sorry, I should have been more clear. THEY NEVER RECIVED THE INTERVIEW LETTER.

Two separate cases..I work for a large company and we have a few people who are going through similar CIS situations. So we stay in touch.

The interivew letter was never received, even though they have not moved or changed hteir address. It just never got to them. So they did not come to the interview. Later they got a notice that their application is denied and the AP/EAD are not longer valid.

Can you believe it? That is terrible. So I am trying to find someone who has recived a letter for the interivew to see if , at least, their status changed on line or something like that....how would you ever know if the interview has been scheduled?
 
I don't understand the part that you mention of both spouses from foreign origin, if they weren't from another country they wouldn't be even had to deal with immigration...or you wanted to specify of certain countries alike?

Did you know their time frames, like when they applied and which DO? so the cause of the denial was that they never went to the interview?

Good luck, I think they can appeal...

Well, there is nothing much you can do about not getting mails properly, but, this is not very abnormal W/CIS(I have read so many cases of denial based on this on few other forums). They may check with the local office, when & where the letter was sent. However if the denial is solely based on NOT SHOWING AT THE APPOINTMENT, then they should file motion to re-open within time frame. This is just my opinion, not a legal advise.

Here is the deal.

--Two guys from work happen to be married to foreign nationals. NO relation between the two guys.

-- Both men applied for a green card for their wives. The difference in filins is months...again, no connection between cases or guys.

-- Neither one received an interview notice. Since they did not receive the notice, they failed to show up for an interview. They simply did not know about it.

-- Both cases were denied due to the fact that they did not show up for the interview.


Bases for denial: absence at the interview. So now they are having to appeal.


MY QUESTION is: is their any way to check if the interview notices has been sent

YOUR ONLINE STATUS DOESN'T CHANGE WHEN THEY SENT INTERVIEW NOTICE, BUT YOU MAY MONITOR THE PROCESSING DATES OF YOUR LOCAL OFFICE CLOSELY & NOTIFY THEM ASAP, IF YOUR DATES HAS BEEN PASSED & YOU HAVEN'T HEARD ANYTHING FROM THEM.
 
Also if an attorney has filed the case on the benificiarys behalf, both the attorney and the benificiary get a copy of the interview notice.
