Interview Experience in San Jose

I've been a silent reader of this forum. I would like to share our interview experience in San Jose in hope to shed some light on your situation.

LC Approval Date: January 2003
1-140 and 1-485 RD: February 2004
1-485 transfered to San Jose: 11/04/04

I am on my husband's case but I also hold my own H-1B visa.

My husband has been with the same company since the beginning but our case was a little tricky:

By the time we received the notification that our case was transfered to San Jose, our 1-140 was still pending (at least the status online had not changed and the company's lawyers said they had not received anything on the 1-140).

My husband's company closed the silicon valley office. The headquarters are in Seattle. My husband has been working from home (California) for the same company for the past 2 years. Two weeks after the case was transfered, his company informed him that they would no longer be able to maintain his position in California and offered him a position in Seattle. Same tittle, same job descriptions, salary 30 % lower to reflect Seattle's cost of living. The company's lawyers submitted a AC21 portability letter to the CSI office in San Jose informing them of this change. Howerver, we did not know the status of our 1-140.

We went for the interview with our lawyer from California. The officer was extremely nice with us. She asked for the employment letter.

She then explained that the case was transferred because of my husband's medical exam. The doctor had not checked the box of "not active disease" in his form. She said that a letter from the doctor clarifying the exam should be sufficient.

Other that, everything was OK and as soon as she received the letter from the doctor he could make the infopass appointment.

My lawyer then mentioned that we didn't know the status of the I-140. We were breathless for a second but the lady informed us, to our astonishment, that it had been approved on 10/22 (before the case was transfered).

That's was it for my husband's case.

She then proceeded to my case. She asked for the marriage certificate and for a couple of documents that proved we lived together (rental agreement, etc...). Everything was ok with my case but unfortunately my name had not yet been cleared by the FBI yet. She said she would send another note to the FBI asking about my status.

By the way, does anyone know if there is any way to submit a request to expedite this process? Our fingerprints were done back in March. My husband's fingerprints were cleared. Mine were still pending.

Therefore, that was pretty much it. We were so luck to get a wonderful officer. We haven’t gotten our stamps yet but we are pretty close.
