Interview Date for Permanent Residence - 485 - One Month before 2 Year Wedding Anniv!

I am writing about obtaining permanent residence. I filed in March '04 in New York City, and finally have an interview date scheduled for December 1, 2005.

At this point, I have a working permit and was given
employment authorization via marriage. My two-year
marriage anniversary will be on December 29, 2005.

To my knowledge, I am required to submit a request to
remove the conditions of permanent residence 90 days
prior to my two-year wedding anniversary.

I assume that I am unable to fill out I-751 (to remove
conditions) until I have conditional permanent
residence.

If the interview goes well on December 1, and my
passport is stamped, what will be my new status? Am I
conditional or permanent? Am I granted a waiver for
the 90 day requirement to submit request for removal
of conditional permanent resident?

I was hoping that I would get the interview after my two-year wedding anniversary? Any ideas? Do I get a conditional for 1 or 2 years and have to re-submit 90 days before?

Any ideas would be greatly appreciated.

Thanks!

I got married on 08/20/2003.And i had my interview on 09/07/2005.So we had a 2 year anniversary on 08/20/2005.Because of that i received my permanent resident card (yesterday)for 10 years!I think you gonna have conditional resident card for 2 years!

Same situation is also in my case. Tomorrow will be my interview (Sept 20), but my 2 years wedding anniversary will be next month October 17. That means I am 27 days behind to fulfill my 2 years marriage binding to avoid temporary GC.

Please reply if anybody got the same situation and what happened then. Does it depend on immigration officer?

Wish me luck for tomorrow’s interview please.

Good luck to everybody.

You been misinformed.
It is not “prior to your two-year wedding anniversary” but two-year after gaining your (conditional) lawful permanent resident status.
Meaning – after your successful interview you’ll be granted a conditional GC (since your marriage is less then 2 years). Then you’ll be eligible to file to remove a condition in September 2007 (90 days before your two-years anniversary as a GC holder).
Here is info you need to read: http://uscis.gov/graphics/howdoi/remcond.htm

Thanks Jane. Do you think this 2 temporary GC years will be included to get a citizenship, 3 years bindings or excluded?

Yes these two years counts towards Citizenship.

Yes.
Amishah’s answer above is absolutely right.
Your three years countdown to citizenship starts on a date you are granted permanent residence (Green Card). And it doesn’t matter if it’s conditional or not.
