INTERVIEW Date CHANGE Question!!!!!!

All experts, need some quick advice.

I recieved my interview letter for 8th Nov in EWR, NJ. My application is based on 3 year marriage to a USC. & PD is March 10th 2005.

I am currently in India with family to attend to my grand mothers sickness and aunts cancer treatment. As such I have been away from US from 20th of July. I am employed but have taken FMLA time off from work. I intend to return to US by first week of December. This is about 18 weeks (140 days) away from USA. I know I cannot be away for more than 180 days to comply with N400 rules. Please correct me if I am mistaken in inferring this. I have all the official paperwork for this in case I have to prove this to USCIS. Also I am maintaining my apartment, car and all other utilies while I am away in NJ.

It is difficult for me to be in US for interview on Nov 8th, unless I change plans and fly in for it. I was considering requesting USCIS to make a date change for me. Can you please share any experiences, facts that will help me make a decision. Is it worthwhile making this change? OR IS IT A BIG NO NO?

if i were you, i would not change the interview date. you will never know when you would get your next scheduled interview anymore.

if you must take care of your relatives, i suggest you to hire someone to take care of them, and you fly back to US for an interview.

after all, you have to do whatever you take to get to the interview.
 
Looks like there isn't anyone who has gone through this process to change dates. In anycase cant you expect to get an re-interview date within 3-5 month timeframe?

I don't know how the Newark DO works for an interview date change. However I do know that in Boston DO they were rather prompt. A cousin of mine recently had his interview scheduled for May 2005, but had to go to India on a planned vacation. He requested a change and got the date changed to July 2005. In fact it came so quickly that the date was just one week after his return from India! I believe Boston DO is scheduling interviews pretty fast. Whether Newark is equally efficient has to be seen. Let us know.

Also I have read somewhere a while back that you can make a appointment with regional passport centers to get US passports the same day in case of true emergencies. Is this true?
 
If you show confirmed travels plans/tickets within the next 14 days and need a visa, you can schedule an appointment at the Regional Passport Agency and they will issue the passport in 1 day. After that, you can get the Indian tourist visa from the Consulate on the same day, if you submit everything properly early in the morning.

As far as re-schedluing the interview, if you decide to do that send a letter to the local DO by certified mail or Fedex. There is no way of knowing how long it will delay you application. Hope for the best that they receive it, and act on it in a timely fashion. There have been a lot of stories that USCIS said that they never got the re-scheduling request so they decided to close the file with a note that the candidate didn't show up for the interview, hence abandoned the application.

Preferably you should also send a copy to the VSC about the interview change request by Certified mail.

How about calling the 800 number, does that help getting a quick confirmation on the interview rescheduling?

This seems to be a tricky issue in general and there is no denying it, but I am keen to find out a way that works with no issues...

I checked with my cousin and found that you need to send the request for a change to VSC. I believe there is a portion on the form that you need to sign and request a change and send back to them. All the best and keep me informed.
 
Genesis1, Thanks a lot for finding out in detail.

Can I request you to find out from your cousin, how long before the interview date did he send in his change request to the VSC? Today is the 4th of Oct and my date is scheduled for the 8th of November! What I am scared about is that even if I send it in by this weekend, the processing delay might cause them to look at it late and cause my application to get void! (Candidate did not show up!)

If I can get in touch with your cousin that will be great, else just find this out for me!

When did you get your letter from USCIS and what is your time line? You should have sent the request immediately. Does your interview letter mention the location where to send the request change? I will find out from my cousin what you asked and get back to you.
Incidentally have you called the 800 number or the Newark number regarding change in date?

Here is the problem, I am away from the US since July 21st as I mentioned in my post. I plan to return back by December 11th (145 days out of the country). [[[[[I hope USCIS does not give me a hard time for this as I am away to attend to bad health of my grandmother ]]]]]
My mails are recieved by my firend in NY. He recieved it in first week of september and was away for 3 weeks and I only found out last week that the date is November 8th. Only when I read on the posts that there is a rescheduling section on the notice did my grey cells register that it can be changed using that form.

I will action it by friday pending some findings. If the VSC can use the 1 month to act on it and register in their system for rescheduling that will be great. I can probably also call the 800 number for VSC and confirm that they have recieved it? Can anybody confirm this?

All inputs are greatly appreciated.

I called the USCIS and they took all details and said they will send a letter to the Newark DO to reschedule it. In addition they asked me to send a letter myself also and keep the tracking information as proof of letter sent.

I have done the same and now its wait and watch. I am not sure if the response will be as fast as what genesis1 describes was from the Boston DO. The only sad thing is the CIS officer could not confirm my original interview date time as per the interview notice so I am wondering what all information the CIS staff have access to.

One question for the experts.... On all the notices recieved, there is an ESC number on the top section and a different ESC number at the bottom of the 797C notice. What is the difference between the two?

I read on an earlier post that you were planning to attend the interview. However, it appears that you have decided to reschedule. Did you send the interview letter in original back to the local DO? I am asking these questions since my daughter has to reschedule her interview at NY Federal Plaza. It is good the TSCIS customer service will send a request to the local DO. Thannks for your info and keep us posted.
 
I sent a typed letter by fedex and since I am out of the US had my brother print & fedex it! I called the Newark DO as well and spoke to them and they said that the request will be entertained only if it is writing.

Unlike the Fp appointment notice, the interview notice does not seem to have a re-scheduling section, so I just typed a letter. Now its wait and watch and keep my fingers crossed that it get handled appropriately!!

The interview letter clearly states that " you must send this letter in original" to the address listed below. So I am wondering whether you did that. Ask your brother to read the letter again for instructions.
