Interview - D/L has different address

Hi,

I was on OPT when I married my husband, a USC. As soon as we got married I moved in with him, but I could not change the address on my D/L because my OPT was almost expired. The D/L i have is still valid but has different address.

I got a letter to have interview for Jan 2006, but I am concerned about it. Would this be a problem?.

The second concern is my Passport has different name, would this also be a problem?

Any advices would be appreciated very much!!

For the DL , why dont you go and get a new one ? or just have the address changed ? they will do it with your EAD as proof.

As for passport, I assume your name is different b/c of marriage as you took his last name. That is not a big issue and a lot of people change their name.If not please elobrate.
 
My passport recently expired and that's when I changed the name. I used the old one in the interview.

They do use the DL as an "address test". Unless you have a legit excuse, for me- NY required documents based on points, at the time I did not meet requirements and I just didn't change it over even though I eventually could. I told the officer I had it before I was married and he said he would check on that. Having a diff address will create a problem. If you can, save yourself the trouble and apply for one with the same address as your spouse.

If there is any evidence at all linking you to your DL address, you're going to have problems. I had nothing going to my FL address- I haven't even been to my uncle's house. If this is your case, you have less to worry about, but please avoid the problem by just changing it over.

Thanks for the input. But I could not change the D/L (the address). DMV refused it because I don't have any valid immigration document. I have not received EAD yet, and the only document I have is OPT which is already expired.
What should I do?

If you're already scheduled for an AOS interview you must have at least a few letters from the USCIS, like the Receipt Notice of the I-485 you should have filed to start the procedures. With this Notice letter I could get my DL renewed.
 
There is nothing to do if they won't give it to you. When they ask tell them the situation.

From my experience with the diff d/l thing- I just want to give you a heads up. If you have been living with your hus then there is nothing to worry about. There is nothing they can ask you for you to worry about.

Which state did you renew your D/L using USCIS receipt? I am in NJ, and when I tried to change mine, the DMV needed the aprove, not the receipt. Can you let me know?.

Dear XYZ, I don't know this issue, but one think I would advice to you about the change of address on you D/L, do not limit yourselt to one officer or one office. If one officer at the department of licence in your state has denied you to change the address on your DL with the documents you have; try another officer in the same department, and if that department denies you. go another one untill you survey all the departments at your state.
The reason I am saying this is that some times some officers do not understand some documents and they just turn you down.
bottom line: be creative :) if all efforts don't work, then go the interview whatever you have and explain the officer at the interview your plight and why the addresses are different; changes are that the officer may be nice. some officers are really nice and easy going: and hope you will find one of those. Good luck and hope you will have your creencard at your first interview :)
 
What you can do is to get a letter from the DMV about their rules to not accept I-485 receipts as proof as your legal status so far. So you are cover about it and that is why you couldn't renew your DL, actually you can download that from their website I think. And get of course all kind of proofs that you were living all these time with your husband and until what time you were living in the other place (from where your DL is). Not all officers get bother with that, but there are some who gets a little picky about it.

I got my DL in Florida.
to get your DL or ID with your new address is mandatory in this state whenever you change your address, and I think the law is similar for most of the states. Once you move, you've got 10 days in Florida to have your ID or DL with your new address. It's mandatory!!
As a non-resident, you need however two valid photo-IDs, in my case my passport and the old FL DL. Because my I-94 had expired I showed with my I-485 Receipt Notice and they provided me with a new DL valid for 2 years... Moreover, the lady was very kind in explaining me that it was only a 2 years-DL because my AOS was pending, otherwise I would have been given a DL valid for a much longer period (maybe 7 years or so)

to have the couple's both IDs showing the exact address is a major and first piece of evidence of your relationship!! It's a must unless you have sound reasons and evidence to prove otherwise.
If there is any kind of statue or statement in NJ preventing you from getting a DL with the new address (e.g. because your AOS has not been approved yet), find it, print it and take it to the interview to give your reasons why your both IDs addresses don't match.
