Interview at the Embassy

Gurus,

I hope you'll be able to help me with this question. Since the requirement is that you don't have to have a job in the EA/EB1 category.

My question is, during the interview at the embassy, if the Consular Officer conducting the interview is not familiar with this type of visa classification, and now asking for the company/organistion you work for in the US and you said you don't have a job in the united states, since this category does not require a job, but you have a job in your country.

Can he/she because of this reject your application?

Your visa can be rejected if you have no means of supporting yourself. The Consular Officer will not re-adjucate your I-140 case, but certain financial requirements must be met to get an immigrant visa. That being said, I have yet to hear about a case being rejected for this reason, but then again I haven't followed the consular processing forums for over 3 years.

Also, I seriously doubt any consular officer is not familiar with all visa classification types.

Thank you all for your answers. I realise that it will be important to at least have enough money in your account that you can live on while looking for work. I have enough money in the US Bank that I can live on for the next three years, also, I have been asked by different org. to contact them when I arrive in the US.

So, the issue of living and not dependent on the US government is not an issue. I also have enough documentation re:my application.
