Internal Medicine Residency on EAD from NIW

Hi all,

i am physician from india and hoping that my i-140 be approved soon based on my research at the nih in the field of cancer research. can i use the ead from my 485 application based on the approved i-140 to start a residency program in internal medicine.

does anybody have an experience this to narrate?

In my opinion, you can start, because that's what for EAD is? Someone should correct me if I'm wrong!

but somebody told me that the EAD can be used to work only for the field of work or a similar area for which you are being granted a national interest waiver. i applied for the eb-2/niw based on my research work at the National Institutes of Health (NIH).

any input will be greatly appreciated.

The problem with using EAD for residency is that, once your I-140 is approved, they might transfer your I-485 to the local INS office for an interview, since you have NIW application. They may ask you to show them your letter of employments at that time. They will certanly ask you what do you do at that time. Then you have to explain why you are not doing your research, but instead of that, you are pursuing the training in Internal medicine. That might be the problem. It is your decision.
 
thanks for the reply, november 1. i have anticipated this to be a potential problem, which is why i am seeking opinions from other people. i have lost faith in my lawyer. he seems to be telling me everything that i want to hear and seems to be interested only in ideas that are likely to fetch him more money from me. he recently told me that it wouldn't be a problem as he has known many physicians in the past who have done residencies on an EAD from approved research NIW petitions, which is in contrast to what he had told me two years ago when i had filed my i-140, i.e. not to do a residency without getting a green card.

i am confused and do not know what to make of his statements.
