Hi:

I filed new I-485 for the EB1 along with interlink/transfer on 17 the october to TSC.
* My checks were not encashed.
* But I received receipt notices for my spouse and myself.
* When I Checked case status, I found that both the CASES REJECTED.
* I am waiting for the returned package with documents and instructions.

I do not know whether I have made any mistake. How did I get receipt notice and then rejection for the lack of documents.

Any thoughts

skvadivel:

If you had sent check and new I-1485, why did you ask to interlink as this new application is going to be separate one based on your EB1-EA.

Anyway wait and see what happens. It could possibly that USCIS might want to interlink your old -485 with EB1-EA and rejected new -1485 and checks encashed.

The plan I had in mind was to send a new application along with request so that if the request is accepted, I would get a reply along with return of my pacakge.

Now wait for USCIS explanation and wishing you to get good news.

My guess

Very much confused at your case.
I guess you meant you tried to interlink your 485 to EB1A.
I guess your new 485 was also filed with EB1A.
Why would you interlink while filing a new 485?
What you did was to try to link two 485s to the same EB1A case!!!

Usually two 485s occur when they were filed with two different 140s, but you were trying to put two 485s to one 140-EB1A.
I am wondering whether this kind of situation is the reason that causes your problem or it is something else.

Here is my reasoning of why I suspect the double rejections is caused by filing two 485s to the same 140:
1, You said BOTH cases are rejected. So, if it is only a (technical) problem with your newly submitted 485, the other NIW-linked 485 should not be rejected.
2, I have not heard that sending a request for interfiling will cause a rejection of 485, so, it is very likely that the rejection of the NIW-linked 485 is NOT due to the request for interfile itself.
3, Based on the above two points, trying to make "two 485s under one 140" might cause some confusion or some other problems that lead to the rejection.

I wish the best luck and please update us when you receive the package. BTW, you may want to call TSC and ask them why the NIW-linked 485 also got rejected.

I meant both the cases ( spouse and myself). The pending I-485 is based on NIW is alive. Interlink request along with new I-485 was filed for EB1

My doubt is how do you get receipt notice without encashing the check.

Sorry for misunderstanding you!
Did you get any update on your interfile request?

Skvadivel,
Please keep us updated of what they say about your I-485.
I am in the similar situation: two I-485 for one person one I-140. My son's I-485 got returned since I didn't sign in Part 4 instead I signed in Part 5, which is incorrect. The check was stamped but not cashed. Of course, no receipt. I signed the old I-485, wrote another check of $225; and added a new I-485 with a another check of $600. In the cover letter, I explained this and hoped they could choose either as appropriate. I hope this doesn't confuse the person who opens the package. Will it be rejected because of the confusion?
The reason I did this is because I didn't want to waste time as my I-140 has been approved. I was afraid that if I just completed the signature and sent the original back, they might return back and say it was considered as the I-485 filed in October. Then I have to file another complete application. The back and forth really delays things, and I am also afraid my son's case doesn't get linked to my I-140 since not filed together now.
Anyhow, when dealing with USCIS, anything could happen. I try to be cautious, but still...
