Is it possible to get an interim EAD (Newark, NJ) for spouse immediately after filing I140/I485/EAD concurrently? Or it is required to wait for a minimum number of days?
If anyone has any information on interim EAD, please share.

Do you know how long the interim EAD is valid for? Do they issue a one-year EAD card as an interim?
 
iEAD is valid for 240 days OR 8 months.

Can we apply iEad for the h-4 applicant whose AOS is pending?based on primary applicant I-140 petition?

U can get i-EAD for spouse on H4 if,
it has been more than 90 days since u have filed the application for EAD for the H4 spouse.

You can do every thing that can be done with a regular EAD.

Only difference is iEAD is valid for 8 months, where as EAD is for a year.

iEAD with RFE

Thanks for all your responses. Does anyone know if it is possible to apply for iEAD (after 90 days outstanding) if there is a RFE on the I-140?

Those who file concurrent I-140/I-485 submission should familiarize themselves with the BCIS practice on issuance of EAD pending adjudication of I-485 applications. Basically, they should remember three rules of the current BCIS policy:

Rule 1: Pending I-485, the applicant is eligible to apply for EAD. If the EAD is not issued by the Service Centers within 90 days, the applicant should obtain Interim EAD at the local district offices, which the local offices should not deny.

Rule 2: Running of 90 days stops when the Service Centers issue RFE for initial evidence with reference to the underlying I-140. When the requested initial evidence is received by the Service Centers, the 90-day clock starts to run all over again. The previously suspended time does not count in counting the new 90 days.

Rule 3: EAD is issued "valid from the date of decision," and does not retroactively go back to the expiration date of the current EAD in the case of EAD renewal. If there is a gap between the two EADS and he/she works during the period of gap, it should constitute an unauthorized employment.

My I-140 has long been approved. I received two EADs (don't know why) last week. My spouse is still waiting for her EAD. We applied at the same time back in April 10, 2003. We both received RFEs in June for photographs. BCIS received them on June 10th. But the initial receipt is dated April 10th and the 90 days will run out today. Is my spouse eligible to apply for iEAD tomorrow? please suggest. Thanks.

EAD --> RD: 4/10/03 --> ND April 11, 2003
I-140 --> RD: 2/14/03 --> ND: 3/14/03 -->AD: 3/27/03
I-485 --> RD: same --> ND: same -->AD: ??
 
Hi guys,

Is it mandatory to apply for the EAD card in vermont service center or one can get iEAD 90 days after I-485 application in local service center (without applying for it in VSC). Please clarify.....

I have not yet applied for my EAD/AP in VS
 
U have to apply for EAD - after 90 days have passed, u can get i-EAD.
i-EAD is not issued based on 485 but EAD application.
