Interim EAD

I had applied for 140/485/EAD back in Dec 2003. I got a 140 RFE and we replied to it and INS received the response

My 140 hasnt been approved yet.
I havent got my EAD/AP yet.

Can I go to the local office and apply for Interim EAD?

I am also in the same situation. I had applied my EAD on dec and i got RFE on 140, my attorney is going to reply by this week.

Once you respond to RFE you can get IEAD that is what my attorney told me. You can go and get IEAD from local office.

The forum in this web site for details about getting IEAD, you can refer that. But, my EAD was applied on Dec 16. Due to my RFE on I140 i have to wait till respond to that. If your current EAD still valid for 2 more months, why don't you wait for that because now they are processing nov 10 2003.

I had similiar situation last year. I-140 was pending and received 1st RFE. I could not get iEAD in San Jose office. I was told the 90 days clock reseted when you received RFE on you I-140. I waited another 92 days after replied 1st RFE and had my 1st iEAD without problem. 2nd RFE was received two months later.
