Hi Guys,

Its been 6 months now i filled concurrently my I 140 and I 485.
I also applied for EAD and AP.
I went to San jose local INS office to get Interim EAD on 91'st Day.
But the officer said my application is with hold cannot be issued
EAD unless it is removed.

Then I contacted my attorney, He said he will enquiry with INS.
And in december 140 landed up with a query asking employer finance reports, we sent them on Januvary 9th.

I checkd the status, on website it said received response it will take 360 days to process.

So, I again went to San Jose office to get interim EAD, After 5 hours of waiting the same officer said same old thing.

I saw in forums lot of guys are getting Interim EAD with pending
140 & 485 at california service center.I completely don't understand why it is a problem with my case?

Any suggestions will be helpful,

Thanks.
Raju.

You got to wait 90 days after responding to the RFE to get an iEAD. In short, the 90 days clock will reset after the service center issues an RFE on your case. The clock starts after they receive your RFE which is Jan 9 in your case.

thanks a lot, But when i went on 91'st day i did't have any RFE's
on any of my applications. My 91'st day was in Nov1'st 2003,
and I got RFE very down in last week of Decmeber.
Do you see any logic?

My understanding after going through this forum, The service center, CSC in particular will put an hold on the EAD applications until a preliminary review on the I-140 petition is done.

thanks sir again, some people are getting exactly in 90 days, that
means do they completed their preliminary review by that time &
remove the hold for them?
If they would have completed my applicationreview on 90 days why did they wait till december to issue RFE?

I saw people got iEAD and then later RFE's on I 140, this
contradicts their general rule?

raju555,
I got my Interim EAD in San jose office after 90 days of application. There is no any problem getting it, it takes around 5 minutes for whole process.
I still heard that there are a few applicant in this forum who can't get I-EAD because of the so called "on holding", but i really have no idea how, when and why it happens?!

thanks, you are lucky, Even i don't understand, Rajesh sir can give some reasons
on why this vary applicant to applicant?
