Interim EAD question

The INS site says an interim EAD can be obtained after 90 days of applying for one . Is it the RD or ND that is taken into account .

Interim EAD

I need your help for interim EAD. MY EAD RD at Vermont is 8/16/02. VSC issued RFE for photo and RFE received by INS on Oct 5. My EAD will expire one Nov 29'02.

Today I went to Arlington for interim EAD, but IO said they can't give the interim EAD because VSC already processing this case. He also called VSC and talked to IO in front of me. Then he said VSC IO reviewing your case from yesterday.

I don't know how to proceed in this situation.

Any idea?
