Interim EAD Procedures

Hello,

I will be applying for my interim EAD and AP from the Local office in Dallas in a weeks time . I would like to know if anyone could help me with regards to the document and the procedures .

Any previous experience from people who have already gotten their interim EAD and AP would be really helpful .

I had to get an interim EAD from the Dallas office in March of last year. The first thing I would advise is to get there early. I ended up going twice (see below), and on the first occasion didn't turn up until about 5am, which meant that I didn't get seen until about midday. The second time, I arrived at 4am and got seen by about 8am. I certainly wouldn't recommend going any later than 6am otherwise I don't think you will get in. Also, be aware that they are closed on Wednesdays.

The first time I attended for the iEAD was on the 91st day after the RD, and about four days before my current EAD expired. After the long wait I was turned away since they said that they cannot issue an iEAD until the existing EAD has expired. I later discovered this is completely wrong, and there is a memo from the director of TSC to the local offices (I have a copy somewhere) requesting that they issue iEADs after 90 days. However, when the officer says 'no', there is very little you can do to argue the case. Therefore, I had to go back once the EAD had actually expired.

As regards interim APs, I don't believe there is such a thing. I think in genuine emergencies the local office can issue an AP which is essentially the same as that provided by the service centre. Luckily, I've always had the AP renewed in time, so I have no direct experience of this. However, I will say that when I went to the Dallas office just before Christmas for passport stamping (finally approved :) ), there was a lady in line immediately in front of me who was trying to get AP to go and visit her sick brother and she was turned away at the initial screening window since although she had a doctors letter, it didn't actually state that he was dying. Therefore, it looks like you need a really serious reason to stand any chance of getting AP from the Dallas office.

The information you provided was really helpful . I just have one more question , I will be going to the Local Dallas office for the first time -- I mean this is my first EAD , I had called the Vermont Services Center ( because I had applied for my 485 and 140 in the VSC and not at TSC but I live in Dallas ) . The Service rep there told me that they were not sure if the Dallas office would issue and interim EAD and that I have to go there to find it out .

I wonder why they will not issue an Interim EAD is my 90 days have passed since my ND. Also , could you confirm the address for me please , The one that I have is :

Address is correct. Go early and carry copy of 765 R. notice copy along with an employment letter & copies. Procedure is pretty simple. No fee is collected. Service center is not an issue.

91 days after RD of 765.

I seem to remember the officer at the Dallas office stating that they issue the interim EAD as a favour to TSC. Therefore, it may be the case that only district offices within the area covered by a service centre can issue iEADs on behalf of that centre. I'm sure someone else in this forum will know if this is the case or not.

The Dallas office operates a pre-screening system whereby you are questioned about your visit before being admitted to the building and assigned a category and a number, as well as being given any relevant forms to fill out. Whatever you do, don't let the pre-screening officer turn you away. Instead, if they are reluctant insist that they let you in to see an actual officer who can make a decision as to whether to grant the iEAD or not. I've seen people manage this, though I'm not sure what there fate was once inside!

The address you give is correct - it is on the west side of Stemmons near Empire Central. Just look for the Burger King on the corner. Incidentally, you don't need any money or photos for an iEAD though you will be photographed and finger-printed while there.

So to list the documents that we need,

1.Orginal and Copy of the receipt Letter for 765 from the INS - This will have the ND on it
2. Passport
3. Photo ID
4. Copy of letter from the Employer .

Please let me know if we need any other documents ,

One more question is that , it is 90 working days and not Service Center working days right ??? .

Neither - it is 90 calendar days.

Incidentally, I only needed the original 765 receipt - nothing else. However, given the power that the individual officers have to turn you away, combined with what appears to be a totally non-uniform level of 'rule-interpretation' among them, I would take whatever paperwork you can lay your hands on.

Do we have to take photo's with us when we got for getting our interim EAD . This is my first EAD . My 90 day period will be over some time by the end of this month .

Any experience would be appreciated.

Anitha R: Did you get a RFE for your EAD? And are you in the process of getting an IEAD? If so, I do not think you will have any problems because they process independently on each other. If your EAD is not adjudicated and is pending with TSC for 90 days, you automatically qualify for IEAD, as per the provisos of INS. In order to get your EAD, you will have to furnish the details asked in the RFE. Optionally, be prepared to have all the needed evidence when you go for IEAD.

I am working on EAD and have applied for the next one. I was wondering if it is possible to get an iEAD even if there was an RFE involved. It seems to be an RFE happy Season at TSC nowadays

You do not need to take photographs with you. As part of the iEAD process you will be photographed and fingerprinted, and they will then make a laminated card using these.

If it was me (as it has been in the past), I would get there as early as possible. The later you get there, the longer the line will be. They stop letting people in at 1.00 or 1.30 and if you are still waiting outside at this time then you will be turned away. However, once inside you are guarenteed to be seem.

BTW, the actual iEAD process takes a while since there are several stages:
1. Screening outside the building to ensure it's worth letting you in.
2. Seeing an officer to get the iEAD approved.
3. Photograph and fingerprint.
4. Actual production of card.
From memory, the process from seeing the officer to getting the card took about three hours.

How does this work . If you get an interim EAD , Do we actually get our original EAD as well. The reason why I am asking is that , I see that these interim EAD are issued only for say 8 months and that the normal one is valid for a year ??

Yes - you will subsequently get the 'real' EAD which unless TSC screws up will be valid for one year from the issue date.
 
Folks ,

My Lawyer had informed me to take a money order for $ 120 ( the cost for EAD , even though I have paid them when I applied for it ) and also photos in the specified format .

I would like know under who's name I need to be taking the money order in e.g. USCIS , BCIS etc ??

My Lawyer had wanted me to take the following things

Signed Form 765
Original Receipts - 765 , 485
Passport
I 94
Employer's Letter
Photo - Format specified by USCIS
Cashier Check / Money Order - $ 120
 
I think your lawyer is being over-cautious.

I am pretty certain that iEADs are always issued free of charge since you have already paid for the EAD itself. (Compare with an emergency AP where it is indepedent of any other AP that has been applied for and therefore would require a separate fee.)

You may as well take the other things your lawyer suggests though I suspect you won't need any of them except perhaps the application form, though they may give you a different version of this to fill in while you are there.

Here is my experience. We wanted to get there by 5am but went there at 6am(we were under the impression that they open at 9am or so). Took EAD receipt and old EAD (I have one, renewal case) and 485 receipt notice. Took cash for the fees but no fees collected (because its interim) and no photos.

Printed out I765 application and took the blank one with me (didn't have time to fill that at home), had sufficient time to fill out I765 application while waiting in line.

I went there at 5:50am, there is a big line (about 100 - 120 people). We were screened outside and given a token number(this process starts at 6am). The screener did verify that we are past 90 days, also asked for current EADs and looked at them(somebody said they were sent back asking them to come after current EAD expired. My EAD expired a week ago). The office opens at 6:30am. We got screened and went in at 7am. We were called at 8am to the counter. We did not make photocopies of 485 and EAD card/receipt notices. That took 10 min for him to make copies. And then he had to answer a personal phone call and finally he came back to the counter and looked at the papers and sorted them again, and informed us that iEAD is for a max of 8 months(240 days) and he will issue that and we get the regular EAD in mail when that is approved. He made couple of papers and put everything in an envelope, sealed it, gave it to us and asked us to go to a different building couple of miles down (Inwood dr exit on I-35) and give it there and they will take a picture and laminate the card and give it to you. We were out by 8:45am and went to the other building by 9am and out of there by 10am.
