I have an approved I-140 and pending I485 filed by previous employer and I485 has pending over one year.
My new employer has gotten the LC approved (but the mail from the DOL in Atlanta did not enclose the copy of LC) and we are trying to file a new I-140. ( My case may not be a strong AC21 case so I try to file another I140)
I know that Pearson Memo said that one can interfile a pending I485 to a new approved I140. But that memo is issued before the concurrent filing is allowed. (correct me if I am wrong) My question is should I wait for the new I140 approved and then interfile the pending I485 or I can interfile it when filing the new I140?
Right now the I140 premium processing is not available so it raises an issue for me.
