Interesting situation

I had applied for I-140 (aug 2003) and 485 (sept 2003) when working for company A. Left company A and joined Company B (H1 transfer) some time in december. However the applications are still pending.

Does it make sense to pursue the applications through an attorney, ie send inquiries since the application is still pending? Are there chances of approval. By the way company A is not doing well these days :(

Called up USCIS Customer support today and they adviced that company A should inquire about the 140 since its pending for a long time.

thoughts?

Did your attroney say anything about the chance of getting I140/485 approval?
I'm in a similar situation that my I140/485 are pending and I need to switch job because my company is closing down. I want to pursue a H1B as it appears to be safer. I just want to know if getting a H1B will affect the underlying 140/485 application.

once you applied for H1B, CIS will get to know your change of employment. for GCprocesssucks, there are only two ways you can do:
1) ask company A to do an inquiry. If company A is nog going to do that for you, i think you may try to do an address change or renewal of EAD/AP hopefully either one will trigger the processing of your I140. Keep your finger cross that you won't get RFE in your case. If you do get RFE, you will need to go to next step, which is riskier.

2) ask new company B to file AC21 to take over the I140. However, it's a gray area if CIS will approve the case, since your I140 is still pending.
