Interesting news on Murthy

Thanks Jai for posting the link. I noticed that several in this forum didn't inform BCIS of change in employer and got approved or waited till they received their RFE to send the AC21. From Murthy's article, it is clear that it is in your best interest to have a clean record. You may get approved today, but you never know when it would be held against you.

Lot of us don't think what will happen 5 years from now when we apply for citizenship.......
We are thinking only of the present. This article should help us in being lot more careful

There are too many ifs here. If BCIS reviews green card at citizenship time then shouldn't all green card holders who changed job also inform them??

Guys,

Read the postings in the thread
Life after The Green Card and please advice - when can i quit.

There is nothing connected with quiting the job with sponsoring company and Citizenship issue. Once you get a "Lawful Permanent Residency" and been a good "Lawful Permanent Resident", I guess applying and getting citizenship must not be a problem. However, if you acquired Lawful Permanent Residency by fraudent (Like never worked with the sponsorer before and after "Lawful Permanent Residency"., or fraud in labor certification with a complaint from the colleage to BCIS, fake certificates etc) and BCIS comes to know of it, it becomes a problem

Kumars68 & gcinjan2003, I think you guys missed the point. The point is for folks switching company before approval and not submitting AC21 (or waiting till RFE to do so). Further the issue is not about citizenship - if you run into problems, they might pull you profile and find that you didn't inform BCIS when you switched company before approval. This could prove fradulent intent. Just my opinion. If you guys still feel that there is nothing wrong in doing it, it is up to you.

I tend to agree with this.
BCIS will appreciate if you can send them a courtesy notice to inform them that you've switched jobs.

There is no requirement that you have to inform, and informing BCIS may unnecessarily raise a red flag.

For all manager types "it's in the need to know basis" :D

There is still no regulations and even if you send a letter they may not receive it and it is best to reply when you get an RFE since there is a reference bar code. There is also no format and there is no information anywhere what to write. If they pass a regulation then if you haven't informed before then you can send a letter. Again idally you are supposed to work for the sponsoring employer after you get a GC. If you ever quit the lawyer then your intent is violated but again lawyers say 1 year is okay and then change your employer. Where does this 1 year come from? It is not mentioned in BCIS. Acutually, should then all GC holders should send their employement change information whenever they change employers?

I , myself had RFE and I was with the same employer then. My employer lawyer replied to RFE. Three months passed and no response. My job got terminated and after 7 days of termination I was approved. Next day after termination I started working for another company with similar salary and similar responsibilities but before I could even send out a letter I was approved. I was hoping for another RFE and send out the new employment. I donot know what the procedures would be if I send out a letter after approval. I think I wll wait for regulations and then probably send the letter if it is required.

Anyway, these are my personal Opinion. I am not a lawyer. For legal advice please consult a lawyer.

I agree with Struggling

My RFE was issued just as I changed jobs - not voluntarily - but because it was necessary ( my project ended) and the RFE was issued before I had a chance to send them the letter.
WHen the RFE came, however, I send them the letter from the New employer, and was approved.

Any ideas what I could have done differently??
