Interesting exchange with lawyer regarding Processing date and retrogression
Guys and Gals,
Today I emailed my lawyer regarding the latest TSC dates being July 2004 and that in Oct 05 my case will be almost 6 months past the processing date. Here is her reply -
Lawyer Quote -
"The immigration service has indicated that you cannot indicate the months that the visa numbers are not available as months past due. The current processing times posted for I-485s are for those that do not have unavailable immigrant visa numbers. Therefore, you cannot say that by October they will be 6-7 months beyond your filing date. But I think that it is fair to assume that they should adjudicate your applications within a few months of the numbers becoming available again.
Further, AILA liaisons will not take inquiries on the status of these cases because the CIS won’t give them any information except that the case is being held in abeyance until immigrant visa numbers become available."
