I e-filed for an EAD renewal last week and went for digital fingerprints and photos to Manchester, NH today. I asked the INS person
if I can work after the current EAD expires but before I get the
new card. He said some companies allow that and some don't.
I said, forget about the company, what does the government say, can I LEGALLY work
before I get the new card. He said that since it's a renewal and
I now have the biometric data taken (pointing to the stamp
on my I-765 receipt notice), I CAN legally work before getting
the new card.
Now I know many people (from BCIS and lawyers) have said the
opposite (and the same too) and his statement is not legally binding in any way, I'm just disgusted that the BCIS cannot clarify
this once and for all. All it would take is one memo from them
saying what the case is, and all this uncertainty could be avoided.
