We started our company about 18 months back and applied for our first H1B transfer last month. Lawyer screwed up the application by applying for LCA from main office where as the new hire is supposed to work at clients site which is not in commutable range. We received a Notice of Intent to Deny saying that the distance is not commutable. They are requesting us to show LCA filed properly i.e. for clients place before H1B was applied. It is impossible as we did not get LCA from right place before applying. What options do we have. Our lawyer doesn;t seem to agree his mistake nor he is suggesting any alternatives.
