Intent for denial

Hello all.
I recieved an "Intent for denial" for my I-485 application. The document states I need to provide ETA-750. Has anyone else had the same experience? I believe the original ETA-750 was filed with the I140 application (that was approved). What are my options? Is it possible to get a new ETA-750 from DOL?

Don't worry, if u can't get from ur employer then try this.

Once a person who shared that he simply filed FOIA and called them, quickly he got his ETA copy from dol.

485 Denied - UN plzzzz help

My 485 got denied in texas service center on Oct
7,2005. The following are the sequence of events.

Sequence of events on I485 denied application.

Date Event

10/07/2004 Filed 140/485 from TSC EB3

04/29/2005 140 Approved

3/13/2005 AR11 Submitted for change of address

3rd week of Mar Called USCIS and initimated address change on I485. No
written confirmation received till date from USCIS
Confirming the change of address.

5/09/2005 Recd request for additional documents (Medical,2004 W2
and employment letter) through email from attorney and
submitted the same. Attorney says she sent back the
response. But there could be a mistake.

6/13/2005 Finger print notification from USCIS sent by attorney to me.

6/22/2005 Completed finger printing.

6/27/2005 Finger print notification for primary applicant only received
at my new address (Was originally postmarked on
6/08/2005 at my old address which was returned to USCIS
and resent on 6/21/2005 (USCIS datestamp present on
fingerprint notification).

The denial notice says that "On 4/28/05 and 6/21/05, the service requested Medical,2004 W2 and current employment letter........" and since there was no
response it is denied for abondonment.

I beleive actually USCIS resent only the fingerprint notice on 6/21/05 (Which I received) which got erroneously recorded in their system as the original
request for additional documents (Medical,W2 and employment letter) being resent and since there was no reponse, they denied.

Current online status says "On June 21, 2005, the document we made based on the approval or registration of this case was mailed directly to the person to whom issued."

I beleive this meesage is for the fingerprint notice they resent to me and nothing to do with the original request for documents (Medical,W2 and employment letter). How ever they have recorded this mail despatch in error against the original request for documents (which attorney says she responded) and hence this denial. Any thoughts?

Any hopes of my 485 getting revived?

I am sorry, but I have to voice my extreme displeasure in censuring you (which I normally never ever do in this forum) for your selfishness in getting your query answered by sneaking it in under this VERY IMPORTANT thread where one guy is literally fighting for his case that has been denied.

You don't need to offer suggestions to his crucial poser. At least don't frustrate him with your distasteful sneak-in.

I apologize in advance if I would have hurt your feelings. However, I just find this to be utterly distasteful and demeaning to the person who is fighting hard to have his case reopened! Be considerate!!!

Please let us know what your lawyer says...I think its sheer miscommunication on INS's part in processing your case. See if you can re-appeal and get your 485 approved.

I had a similar message posted on my 485 a while back. When I would call, I would get a response stating that as per the status, my 485 was approved and there is nothing they can do about it. I somehow managed to get to one of officers and explained the situation. When she looked up the case, she did see it was not approved, and initiated an inquiry.

please check with your lawyer to see if she REALLY mailed your RFE to INS. If she say yes, demand the FEDEX or USPS mail receipt. I highly suspect that she failed to reply to the RFE.

Did your 485 got denied too based on abandonment? Why was it denied for you? If so which number did you call to talk to TSC?

Actually in April'05 when I submitted the documents to attorney, I rechecked with them if they replied to RFE after 10 days and she said yes. What I am thinking is that since the denial notice said that "documents were sent on 04/28/05 and 06/21/05 and there was no response" and I received only the fingerprint notice (not the original RFE) resent to my new address on 06/21/05, there is a mix up between the RFE and the fingerprint notice which was resent.


My attorney said they are going to file MTR.
 
In my opinion, it is very clear that your RFE response was not received by INS. They know you have done FP. FO results are automatcally in the system once you finish it. There is nothing called "response" to FP. You go and do FP, and that' it.

I am almost 99% sure your lawyer messed it up.
 
I am preparing for all scenarios. Assuming that lawyer has not responded to RFE, is it still possible to get the motion reopened? Is there somebody whose case got reopened even though they or their attorney forgot to send response to an RFE?
 
Does anyone know how long does an MTR take to reopen. Do I get a new Receipt # for tracking it and when can I start working again on EAD (on filing MTR or after MTR gets processed and case reopened?)
