Intend to deny

I called the iio and he told me they are sending a notice of intend to deny, i dont have a clue what is that can you guys help me

1- Have you ever been out of status
2- Have you changed jobs
3- Has your company changed names
4- Do you have a police record

Basically these are issues of Intent to Deny

1- Pay 1000.00 you are ok
2- Maybe someone else on this forum can advise
3- Maybe someone else on this forum can advise
4- Maybe someone else on this forum can advise

NB: I would strongly advise you to get your EAD (if you have 1) renewed ASAP, and definately do talk to your lawyer

Comapany changed names? When did that become a ground for intent to deny I-485? AT MOST they would issue an RFE on that.

Unless applicant is aware of something different about the case.. its better to wait for letter to arrive and if possible consult with an attorney. I read somewhere that attorneys do handle such cases frequently .

Thanks for the info guys, i do not have a police record, no change of jobs, but my company changed their name i had my 140 modified,i was not out of status, but my stamp expired i got my renewal of h1 but i did not get a new stamp, anyway i will wait for the notice and see where it go's, thanks for your prompt reply guys appreciate it
 
Contextually you are right. If applicant submits different application with different company names ( say I-140 with one name and I-485 with another) INS might get suspecious about that. I was referring to company name change while I-485 is pending.

Anyway.. I know such times are difficult and the better way to deal with this is get proper and clear documentation and consult an attorney if possible and wait for letter to arrive to get all details instead of losing sleep over this. ( I know easier said than done)
 
Is it possible that somehow INS (I-485 division) did not receive your modified copy of I-140 and they are still going by old copy of I-140??
While you are waiting for RFE letter.. you might want to call IIO to see if thats the case.

I talked to IIO and my msg was updated to we are sending you a notice to indent to deny, i was not out of status, but me and my waife have i-94 which expires in mar 2000 but i have new hi which is until dec 2002 so i was not out of status, do you guys know why a notice to deny is issued thanks

If I am not mistaken I read on another thread that you spoke to an IIO and that they had withdrawn your Intent to Deny Notice, and were sending you a approval letter.

and now this posting again, whats happening buddy???
 
hey july 16

i called up the iio he told me they have taken back the NID and an officer is reweing it but yesterday i heard from the avm msg that a notice of indend to deny was send, have no clue why the iio said that i am waiting for the notice

i called up the iio on friday he told they will send a indend to deny notice to my lawyer, but i called again on monday and iio said the case is being processed, i asked them about the indent to deny they said they took it back and the case is under processing, now that is weird, so hoping for the best RD = 07/31/01
 
this is scary ..

I would be very curious to know the reason ..please post as soon as you get it.

I too have an expired H1 visa stamp (Oct 2000) but a renewed & valid current H1 (till 2003).

After the H1 renewal (in 2001) I had asked my attorney if we need to stamp it officially .. he said if I want I can get it done from St Louis, MO but there is NO NEED so I did not do it.

Now your posting has me worried.

Just a question,
during your I-485 application, did you use your old I-94 when you applied? Maybe your old documents caused the problems...just a thought...

i just got the notice from the lawyer, i was working for com A , they merged with com B, INS wants to find if i have the same position in the new company, The lawyer say's he will be sending the papers showing com A and B are the same and i have the sam position in both Companies, we have send these people the amended I 140, but still they send me a intent to deny notice, hopefully i will be approved soon, thanks guys for all your help, espec to july 16 thanks buddy

After the merge: is your previous company(i.e Company A) tax-id same or changed?
when the company merge happend before I-140 or after I-140 approval or after filing I-485??

Even I am in the same boat. My company name changed but tax-id remains same. I had filed my I-140 with com A. Send I-485 with name com B (com A merged with com B). I am an employee of com A before merge. Now com A renamed to com B. But Com A tax-id remains same.

Is your case is similar or different?

When I called IIO, he said INS is working on my case and hsould hear the decision within a week. But already 15 days passed. AVM has same old song "Process resumed" My details, Rd 08/15 and ND 10/11.

I have a question for you. When you send your I-485 in July, did you also enclosed your H1 extension papers so that INS will know that you are not out of status? I did include, but mine was also not stamped in my pasport that time.

In sept, I renewed the passport and got it stamped in new passport from Dept of state. But I haven't send this information to INS or attorney. But sent to company then. I do not know whether this is causing delay in my I-485 processing. Because, the passport copy which I send to INS was expired last month.

Anybody in the same situation got approved?
